Supreme Court Denies Stay to Challenge of DOL Regulations Narrowing Exemption for Domestic Service Employees

On October 6, 2015, the U.S. Supreme Court denied the Application for a Stay of the August 21, 2015 ruling by the United States Court of Appeals for the District of Columbia, which had upheld DOL regulations narrowing the exemption for domestic service employees. (We had previously reported on the Court of Appeals decision, available at http://www.putneylaw.com/cu_082515.html). Those regulations, which we had previously advised about on September 24, 2013, are now slated to go into effect on or about October 13, 2015. A copy of our guidance with respect to the regulations which will take effect on October 13, 2015 can be found at http://www.putneylaw.com/cu_092413.html. Home health care agencies and other third-party providers must be prepared for these regulations.

Please contact us if you have any questions regarding the exemptions, the regulations, or comparable state and local laws.
